If you are a business that deals with customers, then you need to make sure your terms are fair. The Unfair Contract Terms Act 1977 aims to protect parties against unfair contract terms.
An unfair term is not legally binding on your customer. Enforcers can also take action to prevent any unfair term being relied upon and any party, who has a suffered as a result of on an unfair term, may be entitled to remedies through civil legal action.
As a simple rule of thumb, all of the clauses must be written in plain and intelligible language and must not be “disproportionately favourable” to one party at the expense of another. You must not hide anything in the small print and you must be up-front.
